All messages sent by a completed contact form, as well as signed service agreements, will be kept for an indefinite period.

 

COMMENTS

When you leave a comment on our website, the data entered in the comment form and your IP address are collected. Note that your profile photo will also be visible publicly next to your comment.

 

STATISTICS AND HEARING MEASURES

The Google Analytics tool is used on this site to count the number of visitors per day, determine popular research topics and then adjust the rendering of the website on search engines. This data will not be shared with other third parties at any time.

1. Booking & payment terms

1.1 Making an appointment

To make an appointment, the client must first contact the photographer to choose a date and the ideal package.
The appointment will only be officialized when all the booking conditions have been met and following the confirmation of the appointment in writing from the photographe

 


1.2 Creation fee

A creation fee of $200 is due at reservation, payable by Interac transfer to the address provided in the booking information, within a maximum of 12 hours. This payment is used to cover administrative costs, client file opening, preparation for the session and reservation of this time slot. This creation fee is non-refundable at any time.


This creation fee will be deducted from the total price of the package. The balance of the invoice, taxes included, is payable no later than the day of the appointment, before starting the session.

1.3 Payment terms

A multiple-installment payment arrangement is available under certain conditions, at the photographer's discretion.  The maximum period for settling payment in full for an invoice is 6 months from the date of the invoice.
In the event of an unpaid balance beyond the period offered, the customer understands that it is liable to recovery of costs by a third party.

 

1.4 Appointment Rescheduling 

The customer can request to reschedule an appointment free of charge once, with a minimum notice of 24 hours. The client understands that if he cancels less than 24 hours before the appointment or does not keep his commitment following a rescheduling of the appointment, that another creation fee will be required in order to book again.

The client also understands that the availability of rescheduling is beyond the photographer's control and that the appointment may be postponed several weeks later.

1.5 Weather, Illness and Force Majeure

The photographer reserves the right to move, postpone or cancel an appointment, using her good judgment, in the event of force majeure such as:

 

* Temperature felt above 30 ° C or below -20 ° C

* Bad weather that could pose a risk to the health and safety of all parties, as well as to photographic equipment.

* Illness of the photographer, the client or respective close family member of the parties, which may cause a risk to the health and safety of the photographer, her family or her clientele. The following are qualified as illnesses: fever, bad general condition, congestion, cough, significant runny nose, skin rashes, diarrhea, vomiting, or any other symptom posing potential risk according to the photographer's good judgment.

* Any other cause of force majeure beyond the control of the photographer requiring, based on her good judgment, a postponement or cancellation of an appointment 

 

2. Travel & Other RELATED Fees

2.1 Travel

A total travel of 50km is included in the packages, calculated from the photographer's residence. If a trip exceeding the limit is necessary, a fee of $ 0.55/km will be charged on the customer's invoice.

 

2.2 Other Related Fees

If the contract requires overnight accommodation, parking, ferry, entry to a site, or any other related expense not included in the packages, these will be payable by the customer.

3. Production and Use of Images

3.1 Image creation

The photos, as well as their staging, will be taken according to the photographer's artistic style, as displayed in her portfolio. The client confirms having looked at the photographer's portfolio and editing style before doing the session and agrees to respect this style for the session and the resulting images.

3.2 Image management

Culling is done in order to present the client a quality viewing gallery, including the best images from the session.
Only the photos selected by the customer and edited by the photographer will be delivered to the customer.
These files will have a retention period of 12 months. After this period, the photographer does not keep the files for archiving and is not responsible for the loss of files by the client.
The originals will at no time be supplied or sold to the customer

3.3 Use of images

The images produced may not be used to damage the image and reputation of the photographer.
Photos are for personal use only. They may not be used in any third-party contests or advertising, given or sold without the photographer's consent.
The photographer retains unconditional copyright to all photos taken at all times
.

4. Selection, Editing & File delivery

4.1 Editing included

Only basic editing and touch-ups are included in the packages; including adjustment of brightness, contrast, color treatment, attenuation of small skin imperfections (pimples, redness) to the artistic style of the photographer as represented in her portfolio.

 

4.2 Additional edits

For any precise, more extensive and/or exhaustive editing, an additional fee starting at $30 and higher applies, established according to the work task to be performed. This invoice for additional edits must be paid before starting the editing work.

 

 

4.3 Editing and Images Posting

No photo should be modified, cropped and/or denatured by any change in color (filter) by the customer. It is also forbidden to remove the logo from the provided web photos.

 

The use of WEB files is preferable and strongly recommended for posting online or on social networks, in order to properly identify the author of these photos and especially because they are sized for optimal web display.

 

4.4 Selecting images

A selection gallery will be sent to the client within 14 working days following the session.  The photos in this gallery will have only basic adjustments without retouching, watermarked, to be used for selection only. Screenshots of these photos are strictly prohibited, as they do not represent the actual final work of the photographer.

Other relevant information to know with regards to the selection and delivery of files can be found in the information guide.  The customer will be able to purchase additional files at a cost of $40 each (+ tx) if they wish.

The selection gallery will be active for a period of 2 weeks. An online reload fee of $50+tx is due and payable before the gallery is brought back online if the selection of photos is not completed before the expiration date or in the event of subsequent online reloading.

 

The final client selection must be confirmed to the photographer as soon as it is completed.  In the event of additional purchases, an invoice will be prepared and must be paid before starting the editing work.  The selection will be added to the editing list, in order of priority of receipt of final selection.
The invoice must be paid in full before undertaking any alteration work.

 

4.5 Delivery of files

The processed photos will be sent to the customer within a maximum of 4 working weeks, following the confirmation of final selection, by a personalized download link with secure access by password.

 

Photos will be delivered in 2 file formats: an optimized resolution for 8x12 maximum printing size version with basic printing rights and a low-resolution version for web or mobile use. All photos in web format will bear the photographer's signature.

 

No physical product is included in the packages, only digital formats. The products and prints are available on order and require un delay of up to 8 weeks to for reception.

 

The download gallery will be online for a period of 1 month.
If the customer has not uploaded their photos within the time limit, a charge of $50+tx for the online submission will apply, payable before the online submission
.

5. RULES OF CONDUCT

5.1 Good Conduct

The photographer undertakes to respect the client's personality in all circumstances. The client agrees, for its part, to respect the work of the photographer through his desire to do well, his patience and his motivation. 

 

The client is also responsible for the people accompanying them, so that there are no injuries, accidents or equipment breakage.

The client understands that, at any time, the photographer can stop the shoot if there is a lack of participation or goodwill on the client's part or if she feels her safety is at risk. 

The client could be required to reimburse the photographer in the event of equipment breakage by the client and their companions, and is liable to legal action in the event of breach of contract. 

 

6. Punctuality and Tardiness

6.1 Punctuality and Tardiness

If the client is late for the appointment, they must notify the photographer as soon as possible. This delay will be cut from the session time. 

In the event that the client is more than 20 minutes late, the photographer reserves the right to immediately cancel the session and leave the premises or the studio, and will notify the client in writing. The client will therefore have to make a new appointment on another date and pay a new reservation fee. 

7. DISCLAIMER AND Responsibility LIMITS

7.1 Physical Responsibility 

The photographer must be in direct physical contact with the client or their child(ren) during the session (especially newborns and young children) to ensure optimal and safe positioning. These manipulations will be carried out in a necessary and safe manner, and respecting strict hygiene rules. 
 

The customer is aware of the risks associated with physical contact and undertakes to accept them.

The photographer cannot at any time be held responsible in the event of an injury, contamination or accident. 

7.2 Wardrobe, Hair & Make-Up

The photographer can not at any time be held responsible for the choice or state of clothing, hairstyle and/or make-up chosen or worn by the client.

Reshoot of photos may be possible in the event of dissatisfaction, at the usual session fees, with the photographer's consent and if the schedule allows.

No refund will be made in the event of customer dissatisfaction with the aesthetics of their photos, physical, bodily or clothing dissatisfaction.

7.3 Photo Prints

If the client wishes to print the images, the photographer offers professional quality printing services.  The photographer takes great care to calibrate her equipment in order to offer an optimal quality result of her products. She guarantees the quality of printing and results of orders placed through her only.

If the client chooses to order prints of the images elsewhere, the photographer is in no way responsible or caution their result. 

 

7.4 USB Key

If the customer wishes to have the images on a USB key, it can be purchased directly from the photographer upon request, at a cost of $49+tx per key.

Only the keys purchased by the photographer will be used, for electronic equipment security reasons.
No key provided by the customer will be accepted

8. SPECIAL MEASURES & COVID-19 

 

8.1 Special Measures

In the event of a government ban on operating or a lockdown leading to the closure of photography services, the session may be postponed free of charge to a later time after deconfinement, according to the photographer's schedule.

 

At the photographer's discretion , a gift certificate may be given to the client and be applied to a future session at regular price after reopening.
